Vacation Rental or Bust
Home buyers and real estate investors often ask what properties can be used for vacation rentals on Oahu Hawaii.

The short answer would be to refer to the list below for potential investments, however many buyers and investors need a better explanation why they can’t rent their home or in-law suite as a vacation rental in a residential area.
Bill 41
On October 19, 2021 Bill 41 relating to transient accommodations was introduced by Honolulu City Council. This bill was enacted under the idea that reducing the number of tourists in vacation homes would resolve traffic, overcrowded beaches and affordable housing problems. The city Department of Planning and Permitting (DPP) introduced a revised vacation rental bill that has and will change the way many home owners use their properties.

In detail the bill reports month-to-month rentals anywhere outside of Waikiki, Ko’olina and Kuilima would be illegal. This would require that all rentals outside the three areas be 180 days (six months) or greater.
As a part of Ordinance 19-18, the DPP was required to create a set of enforcement rules through a public process. The resulting rules would become the legal administrative process that DPP would have to follow to shut down illegal operators. Currently this bill makes little distinction between shorter rentals (greater than 30 days but less than 180days) A vacation rental unit for tourists is typically less than 30days.
This bill seeks to improve on the Ordinance 19-18 by providing a more comprehensive approach to regulating transient accommodations and creating additional sources of funding for administering and enforcing short-term rental and transient accommodation laws.

Not all properties and home owner associations (HOA) permit daily rentals in the three resort areas. It is strongly advised to speak with a real estate agent to help you to determine the best property for you. Mahalo!
